Garage/Yard Sales

A temporary accessory use on a residential lot that includes the display of personal possessions within a garage, porch or front yard, and those of friends, relatives and neighbors, for sale to the general public upon the property of one’s residence subject to the following conditions:

1) One (1) 4 ft.2 (4’x4’) sign or smaller in size shall be allowed on the property, no sooner than seven (7) days prior to the sale, and removed promptly upon the completion of the sale.
2) The conduct of Garage or Yard Sales beyond the extent described herein represents a commercial or retail business and requires appropriate compliance with those specific standards found within the current zoning ordinance.
3) In no case shall any aspect of the garage or yard sale be conducted in the street right-of-way.
4) Garage and yard sales shall operate between the hours of 8:00 a.m. and 6:00 p.m.
5) The property owner shall obtain a temporary use permit from the Borough for Garage and Yard Sales in order that the temporary use does not exceed the three (3) day limit and twice per year. The cost of the permit will be established by resolution of the Borough Council.
6) There shall be no sale of retail property purchased solely for resale by the property owners/tenants and not for the property owners/tenants personal use.
7) After the sale period has expired the personal property in the sale must be removed from the outside of the premises including the yard, driveway, open porches and stored inside an enclosed porch, the dwelling, inside the garage, and/or inside sheds unless the personal property is utilized for a specific purpose on the outside of the residence.
8) Plastic tarps and open walled structures without a roof are not considered sheds and will not be allowed for the storage of the personal property after the three day sale period has expired.
9) The property owner shall only be allowed a total of two (2) sales per year, whether they are advertised as a garage sale, a yard sale, or a combination garage and yard sale.
10) The Borough shall require a temporary use permit for each garage sale which will insure that the garage sales do not exceed the three (3) day limit and are only held twice each year. The initial cost of the temporary use permit shall be free of charge. However, the Borough Council shall establish a fee by resolution if it becomes necessary during the administration the garage sale program.

Junk Motor Vehicle

A motor vehicle, including but not limited to an automobile and truck, that is worn, deteriorated, obsolete, dismantled or disassembled as to make it inoperable or unusable in its existing condition, and/or a motor vehicle which has become incapable of being operated for a period of thirty (30) days due to mechanical defeats and/or because it is not licenses and/or does not have a current valid Pennsylvania inspection sticker. NO person shall maintain or keep a junk motor vehicle within South Waverly Borough for a period exceeding 30 days unless such junk motor vehicle is kept or maintained wholly within a building having four walls.

Brush, Grass & Weeds

It shall be unlawful for any person owning or occupying any property within the Borough of South Waverly to permit any grass or weeds or any vegetation whatsoever not edible or planted for some useful or ornamental purpose to grow or remain upon such premises so as to exceed a height of twelve (12) inches, to throw off any unpleasant or noxious odor, to conceal any filthy deposit or to create or produce pollen. The cutting of such grass, weeds or other vegetation twice a month in the months of May, June, July, August and September and the removal of the grass, weeds, or other vegetation so cut shall be deemed evidence that no violation of this section shall have been created.

Pooper Scooper Law

It shall be the duty of any person owning, harboring or having the care, custody or control of any dog to promptly remove any feces left by such dog on any common thoroughfare, sidewalk, passageway, Public Street, play area or park or any place where people congregate or walk on private or public property.

Property Maintenance

All exterior property and premises shall be maintained in a clean, safe and sanitary condition. The occupant shall keep that part of the exterior property which such occupant occupies or controls in a clean and sanitary condition. All exterior property and premises and the interior of every structure shall be free from any accumulation of garbage.

Swimming Pools

Swimming pools shall be maintained in a clean and sanitary condition and in good repair. Private swimming pools, containing water more than 24 inches in depth shall be completely surrounded by a fence or barrier at least 48 inches in height above the finished ground level measured on the said of the barrier away from the pool. A building permit is required to install a swimming pool.

Building Permits and Contractor’s License

Prior to beginning any construction project – you must verify if a building permit is needed. Please contact the Building & Code Enforcement Officer Jesse Harris for directions. Mr. Harris can be reached at 570-888-2125 ext. 23. Also, all contractors’ working in South Waverly Borough must have obtained a contractor’s license prior to working for you. To protect yourself – make sure your contractor has purchased his license. You may contact the borough office for a list of licensed contractors.

RECREATIONAL FIRES

Ordinance No. 10-5-15 – Air Pollution, Open Burning

A 3 year permit will be issued to the property owner to have a recreational fire.

South Waverly Borough Recycling – DOOR TO DOOR

Beginning Thursday, January 3, 2013, Taylor Garbage Services Inc. will collect recyclable materials from each household and business in the borough.  Collection will then continue once per week each Thursday.  Each Residence and Business must provide their own recycling container (35 gallons or less).  A “Single Sort Recycling” sticker must be attached to the container to show that you are part of the borough’s program.  Containers should be placed on the curb either the night before collection, or by 6:00 AM the day of collection.   The new program allows for commingled materials (no sorting required) and plastic types 1 through 7 are now accepted.  Businesses or Residents with recycling needs greater than one 35-gallon container per week should contact Taylor Garbage directly to make special arrangements for collection.
